Website accessibility

Website accessibility refers to the practice of designing websites so that people with disabilities and those with different or diverse abilities can understand content, navigate and interact online and have equal access to information and functionality. We are actively working to improve our website to provide a website that is accessible to the widest possible audience. We are striving to ensure our website is consistent with the World Wide Web Consortium Web Content Accessibility Guidelines (WCAG) 2.0 and is usable with assistive technology.

Communication

We are committed to communicating with customers with disabilities in ways that take into account their disabilities. This means that employees communicate in a manner that enables customers to communicate effectively, and to use and receive information about our products and services.

Service animals and support persons

Customers with disabilities may be accompanied and assisted by a support person, and may bring their service animal on the parts of our premises that are open to the public, subject to any other applicable laws. We strive to ensure that people involved in dealing with customers are appropriately trained in how to interact with customers in these cases.

Sometimes, we may determine that a service animal cannot enter a certain area, or a customer may need a support person to provide the necessary assistance but not have one available. In these circumstances, we will use our best efforts to suggest reasonable and appropriate alternatives to provide assistance.

Notice of temporary disruptions

We will notify our customers promptly in the event of a planned or unexpected disruption to services or facilities for people with disabilities. Our training for employees, volunteers, others who interact with the public on our behalf, and people who develop our customer service policies will comply with applicable accessibility laws, and may include:

Enterprise Privacy Statement

Good privacy management stems from good privacy governance. At Foresters we hold ourselves accountable for protecting the privacy of the Personal Information entrusted to us by our members, customers and employees. Proactive management of Personal Information creates a culture where the importance of privacy management is understood and thereby adds value to our organization, our members, customers and employees. Personal information is any information about an identifiable individual, such as name, age, address, gender, government identification numbers, financial information, health information and medical records. It may also include online identifiers, such as IP addresses and cookie identifiers. (“Personal Information”).

 

Scope

This Enterprise Privacy Statement (“Enterprise Privacy Statement”) applies to all Foresters Financial (“Foresters”) business operations and subsidiaries. Foresters is an international financial services provider operating in Canada, the United States and the United Kingdom. Foresters complies with applicable privacy/data protection laws in the jurisdictions where we do business. The privacy principles described below are supplemented by more detailed privacy policies that reflect the requirements of applicable laws in the countries in which we operate. We will provide you with these policies if they apply to your Personal Information. These specific policies will govern in the event of a conflict with this Enterprise Privacy Statement.

Privacy Principles

We adhere to the following principles when handling Personal Information:

Accountability: We are responsible for Personal Information under our control and establish this Framework for managing privacy across all our business operations. We have designated individuals who are responsible for monitoring compliance with these principles, our policies, practices and procedures and the expectations of our regulators.

Transparency – Individuals have the right to be information about the collection, use, disclosure and retention of their personal information. We make information about our privacy policies and practices readily available to individuals, subject to any exceptions permitted by law.

Identifying purposes – We will be transparent about our privacy practices and will clearly identify the purposes for which we collect, use, retain and disclose Personal Information.

Lawful basis – We will only collect, use and disclose your Personal Information as reasonably necessary for the identified purposes, and only do so where there is a lawful basis. Sometimes, this will be with the knowledge and consent of a member, customer or employee. At other times, it will be on the basis of a contractual obligation, legal obligation, our legitimate interests or vital interests. But in each case only to the extent necessary to fulfill that obligation or interest. Where we require your consent, we may obtain it in writing, verbally, electronically or through an authorized representative. Consent may also be implied.

Limiting Collection – We will limit the collection of Personal Information to that which is necessary for the purposes we identify, and we will collect it fairly and lawfully.

Limiting use, disclosure and retention – We will not use or disclose Personal Information for purposes other than those for which we collected it, except with your consent, or as permitted or required by law. We restrict the access to and disclosure of Personal Information to those who have a need for the information. This may include our employees, licensed representatives or service providers who need the information to perform their duties or to provide us with services. It may also include other companies within the Forester group of companies. who, from time to time, may offer or promote other financial products, benefits or services, or those of select third parties, that we believe may be of interest to our members and customers. We may also have joint marketing or distribution agreements with other financial institutions that may offer or promote products that we believe may be of interest to our members and customers.

In some instances, our employees, advisors, service providers, representatives, reinsurers and any of their service providers may be located in other jurisdictions outside Canada. Personal information may then be subject to the laws of those other jurisdictions and these other jurisdictions may have different privacy and data protection laws than your jurisdiction. All such persons, whether or not they are located in Canada or outside Canada, are required to protect the confidentiality of personal information in a manner that is consistent with our privacy policies and practices, in compliance with applicable law.

We do not retain Personal Information longer than is reasonably necessary or relevant for the identified purposes or as required by law. Once retention of Personal Information is no longer reasonably necessary or relevant for the identified purposes, nor required by law, it will be destroyed, erased or made anonymous. We establish policies setting standard retention periods for each jurisdiction.

Accuracy – We make reasonable efforts to keep Personal Information accurate, complete, and up-to-date as is necessary for the purposes for which it will be used.

Security safeguards– We will classify and protect Personal Information by security safeguards appropriate to the sensitivity of the information. We make reasonable effort to prevent any loss or misuse, or any unauthorized disclosure, destruction or modification, of Personal Information.

Individual Rights – Upon request, and as required by applicable laws, we inform authorized individuals of the existence, use and disclosure of their Personal Information and give them access to it as required by law. Individuals may challenge the accuracy and completeness of their information and have it amended, as appropriate. Subject to applicable laws, individuals may also request us to delete the personal information we hold about them. We will consider all such requests and provide our response within a reasonable period, and as required by such laws. Certain personal information may be exempt from such requests in certain circumstances.

Protect your Identity
The act of deliberately using someone else’s Identity is known as identity theft. Identity theft is a growing problem that affects thousands of individuals annually. Always be aware of new ways in which you are at risk for identity theft.

How do I prevent Identity Theft?

Identity theft can be prevented by not giving away unnecessary information. Sometimes it occurs as a result of negligence. To minimize the risk of becoming a victim of identity theft, there are some basic steps you can take.

  • Verify that your computer is protected by Antivirus software
  • If you use a laptop for business or personal use, ensure that it is encrypted. That way, if it is stolen, the information contained on that machine is more difficult to retrieve
  • Protect your various accounts with a strong password and change it on a regular basis
  • Never click links in suspicious emails and don’t open attachments from untrusted senders
  • Don’t respond to emails requesting your personal or account information
  • Always look for the “security lock” icon before supplying credit card information on any website
  • Do not input personal information on a computer in a public place, like a library, coffee shops, etc.
  • Be wary of phone calls during which which someone is asking for your personal information
  • Securely store documents that include confidential information
  • Keep your financial, medical and insurance files in a secure location
  • Shred documents that contain important personal information and commercial information about you.

Phishing scams

Phishing is a type of social manipulation that uses malicious emails and websites to steal personal information like passwords, banking details, credit card numbers, etc. in order to make financial gains. Most phishing emails contain links and attachments linked to ransomware.

How can I detect a phishing email?

  • Do not click on any links provided in any emails you receive.
  • If you are unsure about the link provided, enter it directly into your web browser to validate it.
  • Do not respond to emails that ask you to provide confidential information. Legitimate emails will not ask you to provide such information.
  • If you have any concerns, call the company directly and inquire.

Computer security tips

There are some best security practices that can help protect your information:

  • ActiveX – this technology is used by the Windows system and by Internet Explorer. Using this technology can increase the attack surface by allowing Internet browsers to install programs automatically. If ActiveX is not used anywhere in your browsing experience, it can be disabled.
  • Plugins – these are applications designed to extend the functionality of the browser. But they may contain programming defects, such as buffer overflows, cross-domain violations, etc. Do not enable plug-ins if you are not familiar with them or use them during your browsing experience.
  • Cookies – cookies are files used to store information that will be transmitted automatically to browsers as you browse. They may also contain user identification and other sensitive information. Avoid enabling cookies in your browser and regularly clear your browsing history.

Make a backup of your data – All computers and their components can fail. Although this probability is lower today thanks to modernized technology and improved reliability, it still represents a risk. Systems failure is the main cause of data loss or corruption, and when it occurs, the only option is to restore data from a backup file.

One of the most common causes of data loss is the physical failure of the media where the data is saved. Normally, hard drives will work for years without incident, but eventually they will fail. This may happen gradually or suddenly, and sometimes the hard drive may fail without any warning. Many people underestimate the importance of backup files until they experience the unexpected loss or corruption of valuable data.

A Special Notice about My Foresters

Foresters Financial members are currently only those insured under a life insurance certificate issued by The Independent Order of Foresters. If you are a Foresters Financial member, you may be eligible to register for My Foresters, an online member information service that allows you to view your member benefits package, to register for member events, and to receive other information or services related to your Foresters membership. You will need to meet the eligibility requirements on that site; for example, you must be at least 16 years of age.

To use the My Foresters site, you will need a user name and password, and any additional security measures that Foresters may require. By obtaining a user name and password, you agree that:

  • You are responsible for keeping your user name and passwords safe
  • If someone signs in to the My Foresters site using your user name and password, we can treat that person as if they are you
  • We cannot, and are not required, to confirm the identity or authority of anyone who uses our online services, except by ensuring their password matches their user name
  • We can rely on this user name and password as electronic identification, to accept instructions given online as if you had given us written signed instructions

How long do we keep information?

Collecting your information helps us to:

  • Offer, assess your initial and continued eligibility for, and to administer and deliver, products and services
  • Market and improve our products and services  
  • Adjudicate claims, process payments and respond to your inquiries or complaints
  • Identify, detect or prevent fraud or security breaches including verifying your identity  
  • Communicate about membership, hold community events and activities, and operate our branch system
  • Support and optimize users’ experience on our websites and applications

How we share your information

The law allows us to share certain information we collect. It also gives consumers the right to limit some, but not all, sharing. We do not share information about our customers or former customers with anyone, except as set out in this notice or in a prior authorization.

You may also review your information in person at our Head Office. We may charge a reasonable fee to cover the costs incurred to provide you with copies of any requested information. If we agree to your request, we may correct, amend, delete or anonymize your personal information, as applicable, and notify affected parties as required by law. If we do not agree to your request, we will let you know. We may maintain a record of your request in our files. This Online Privacy Notice for California Residents (“Notice”) supplements the information contained in Foresters Enterprise Privacy StatementUS Privacy Policy and Online Privacy Statement and our California Privacy Notice and applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”).

Information we collect

We use several technologies to collect information for business purposes about visitors to Foresters Sites. This may include information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly with an individual or with a device (“personal information”).

Personal information does not include:

  • Publicly available information from government records.
  • Deidentified or aggregated consumer information.
  • Information that is specifically excluded from the scope of the California Consumer Protection Act including:

Over the last 12 months, we may have collected and/or disclosed the following categories of personal information for a business purpose:

  • Online identifiers, such as a name, alias, address, date of birth, Internet Protocol (IP) address or other unique identifiers.
  • Internet or other similar network activity, such as browsing history, search history, information about a consumer’s interaction with our Sites, or advertisement.
  • Geolocation data, such as information about the location of consumers or their device(s).
  • Professional or employment related information, such as when applying for a job opportunity, including current or past job history.
  • Non-public education information, such as education records provided when applying for a Foresters Scholarship, including grades, transcripts.

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

Deletion Request Rights

You have the right to request us to delete any of your personal information that we hold, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may not be able to honor your request if retaining the information is necessary for us or our service provider(s), such as to:

  • Complete the transaction for which we collected the personal information, provide a product or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Identify errors, repair or maintain systems, including errors that impair existing intended functionality.
  • Comply with our legal and regulatory obligations.
  • Enable internal and lawful uses of that information that are reasonably aligned with consumer expectations based on your relationship with us and compatible with the context in which you provided it.

 

Exercising Access, Data Portability, and Deletion Rights

To exercise any of the rights described above, you can submit a consumer request in one of the following ways:

To respond to a consumer request, we will need to verify your, or your authorized representative’s, identity or authority to make the request. Only you, or your authorized representative, may make a consumer request related to your personal information. You may also make a consumer request on behalf of your minor child. We will not be able to respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

You may make a consumer request for access or data portability twice within a 12-month period. The consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

Making a consumer request does not require you to create an account with us.

We will only use personal information provided in a consumer request to verify the requestor's identity or authority to make the request.

 

Response Timing and Format

We endeavor to respond to a consumer request within thirty days (30) days of receiving it. If we need more time, we will inform you, in writing, of the reason and extension period.

We will deliver our written response by regular mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding receipt of the consumer request. If applicable, our response will also explain the reasons we cannot comply with a request. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We generally do not charge a fee to process or respond to your request unless it is excessive or repetitive. If we determine that a fee is necessary, we will tell you why and provide you with a cost estimate before we complete your request.

 

Non-Discrimination

We will not discriminate against you for exercising any of your rights under this Notice unless permitted by law.

 

Changes to our Privacy Notice

Social media

We use social networking platforms such as Facebook, Instagram, LinkedIn, Twitter and YouTube (“social platforms”) to provide product and service information, articles, news, community events and career opportunities. Any content you post on social platforms, such as pictures, videos, information, “Likes”, or any personal information you choose to make available on these platforms is subject to the terms of use and privacy policies of those platforms. Joint accounts

Unless we are notified otherwise and provided such documentation as we require, joint brokerage accounts shall be held jointly with rights of survivorship (payable to either or the survivor). Each joint tenant irrevocably appoints the other as attorney-in-fact to take all action on his or her behalf and to represent him or her in all respects in connection with this Agreement. We shall be fully protected in acting, but shall not be required to act upon the instructions of either joint tenant. Each joint tenant shall be liable, jointly and individually, for any amounts due to us pursuant to this Agreement, whether incurred by either or both joint tenants.
